TNC Regulatory Requirements

The following briefly summarizes the regulatory requirements for TNCs.

Registration

New systems, or existing systems that have not done so, must register with the Water Supply Division (WSD).  To register, complete the Public Water Supply Survey form and the Water System Officials Contact form, and submit them to the WSD.

Permits

TNCs must have 1.) a Permit to Operate before serving water to the public; and a 2.) a Source and Construction Permit before constructing or modifying drinking water system components (i.e., sources, storage, treatment and distribution lines).

Certified Operators

All TNCs must have a certified operator, whom is responsible for insuring the proper operation of the water system and overseeing water quality monitoring. Many systems are operated by their owners or employees, but some owners choose to hire a contract operator.

Water Quality Monitoring

To insure that the drinking water is safe, TNCs must collect samples for source permitting and routine monitoring.

Reporting and Record Keeping

Systems must report water quality results in a timely fashion, complete monthly (for some systems) and annual reports, and keep records for specific time frames.

Public Notification

TNCs must notify the public any time the system violates State or Federal drinking water regulations or has other situations that pose a risk to public health. The people who drink the water have the right to know what happened and what they need to do to protect their health.

Site Visits

Each TNC must undergo a sanitary survey every five years. A sanitary survey is an on-site review of the water sources, facilities, equipment, and operation and maintenance of the water system. WSD staff will conduct the survey with the system owner and/or operator. The owner or operator needs to be present to discuss system operations and to show WSD staff the water source, storage tanks, and treatment. If not already completed, a source water assessment and ground water under the direct influence of surface water (GWUDI) determination will be done for each drinking water source.
